To maximize your legal position and security of ownership I propose to provide the following documents to you.
- of the land and building work proposed will be carried out. This covers aspects such as authenticity and status of land ownership and land certificates, possible claims on the land, land zoning, land demarcation, legal access to existing roads and other amenities including water and electricity, building permit status and building regulations, property and other tax payments, village and neighbourhood relations and conformity with all local and cultural laws and norms, is suitable and allowed to be used for the purposes of the project and meets all other legal and building regulations and obligations. Without a favourable Due Diligence report no land will be leased or building work commenced.
- between land owners and the PMA company to be formed and between the company and you, the villa owners.
- listing structure, shareholding, management and the rights and responsibilities of the company in regards to the sale of villas and other assets it holds.
- -the official document from the Indonesian Ministry of Justice upon establishment of the PMA company.
- listing responsibilities and obligations of the builder towards the company and individual villa owners. The Contract will include a 2 year builders guarantee on all building work
- outlining the rights and responsibilities of villa owners in relation to the company’s management of the complex.
I expect all or most of these documents to be available to you before or immediately after villa owners make their first payments. Any delays in providing documents will not reflect any reluctance on my part but rather the time it takes here in Indonesia to process many legal and other administrative documents.
